Please read these Terms and Conditions carefully before booking our services. Upon entering into this agreement, You, the client agrees to be bound by the terms within.
Securing your booking with us by payment in full, constitutes affirmation that you have read, understood, and agreed to the following terms and conditions.
1. Courses and Workshops
Course / Workshop: any course providing training and instructions provided by Zoliab and Courses will be interpreted accordingly.
Event Outside Our Control: any act or event beyond Our reasonable control, including without limitation injury or illness of a Course tutor, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
Bespoke Training Courses: as defined in clause 3.1.
Terms: the terms and conditions set out in this document.
We/Our/Us: Zoliab Limited, a company registered in England and Wales with company number 07181429.
2. Our Right to Cancel a Course
i. We may cancel a Course at any time by providing you with at least 14 calendar days' notice in writing.
ii. We may have to cancel a Course at any time if:
iii. If we cancel a booking in accordance with clause 2.i or any of the events specified in clause 2. ii. happen:
iv. We may cancel a Course at any time with immediate effect if:
v. In the event that we cancel any Course in accordance with our rights set out above we will not be liable to you in any way with regard to paying for or contributing to any costs, expenses or other monies spent by you in preparation for your attendance at a Course such as, for example only, travel expenses or the purchase of materials for use at a Course.
vi. Any refunds will be made to the credit card or debit card which was used to pay.
3. Your Right to Cancel a Course
Before you have attended a Course, you have the rights to cancel (other than Courses specifically tailored to your requirements which include, without limitation, those which take place at your workplace or home and bespoke ):
You may cancel a Course at any time however the following cancellation charges will apply:
i. over 30 days from the date on which the Course is due to start – full refund of any payment made in advance and the option to book another Course on a different date.
ii. 15-29 days from the date on which the Course is due to start – 30% of the cost of the Course will be charged if you choose to book a Course on another date. There will be no refund for no attendance.
iii. Within 14 days from the date on which the Course is due to start – 50% of the cost of the Course will be charged if you choose to book a Course on another date. There will be no refund available for non-attendance; and
iv. within 7 days or ‘no-show’ – 100% of the cost of the Course will be charged if you choose to book a Course on another date. There will be no refund available for non-attendance.
v. Subject to clause 3.1.3. in order to cancel you must contact us by email at enquiries@zoliab.com.,by telephone 01375 506 706 and we will confirm the terms of your cancellation in writing.
vi. If, before a Course has taken place, we are affected by an Event Outside of Our Control, you may cancel a course by contacting us by email at enquiries@zoliab.com If you cancel a Course for any of the reasons and we have already incurred any costs in respect of that booking, in addition to any cancellation charges payable clause 3,.you agree to pay us any costs we reasonably incurred and this charge will be deducted from any refund that is due to you or, if no refund is due to you, invoiced to you. We will tell you what these costs are or by telephone. If you have made any payment in advance, we will refund these amounts to you.
viii. All refunds will be made to the credit card or debit card used by you to pay.
ix. For bespoke Courses, which are designed to your specific requirements, you are not able to cancel such a Course and receive any form of refund once your booking has been made. It may be possible where there are mitigating circumstances and reasonable notice is given to Us to alter the date of a bespoke Course on one occasion and in such circumstances you will be liable to pay any costs or expenses incurred by Us as a result of the change of date.
4. Events Outside Our Control
i. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.
ii. If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms:
We will contact you as soon as reasonably possible to notify you.
iii. Our obligation to provide the Course will be suspended and the time for performance of Our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects Our performance of a Course, we will use reasonable endeavours to provide an alternative course date as soon as reasonably possible after the Event Outside Our Control is over.
iv. You may cancel the Course if an Event Outside Our Control takes place and you no longer wish to take a place on a Course. Please see your cancellation rights under clause 3.2.
v. We will only cancel the Course if the Event Outside Our Control continues for longer than 4 weeks in accordance with Our cancellation rights in clause 2.2.1.
5. Confidentiality
You hereby agree that:
i. you will not without Our prior written approval photograph or video or use any other similar recording device to record any part of the Course;
ii. If you are given prior written approval in accordance with clause 5.1. you will not make available to the public or any other party or parties any of the photographs or videos without Our prior written approval after providing Us with details of how they will be made available.
iii. you will accord us credit on any use or reproduction of the Recorded Material as We may permit should we so request and will provide contractually in agreements with all other parties who display the Materials that they will accord us the same credit;
iv. you will keep in strict confidence all technical or commercial know-how, specifications, inventions, processes or initiatives which are of a confidential nature and have been disclosed to you by Us or which you may become privy to by reason of your attendance on a Course. You will only disclose such confidential information as is required to be disclosed by law, any governmental or regulatory authority or by a court of competent jurisdiction.
6. Links to Other Web Sites
i. Our Service may contain links to third-party websites or services that are not owned or controlled by zoliab.
ii. Zoliab has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Zoliab shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
7. Changes to Our Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time so please check these Terms each and every time you place a booking for a Course as the Terms in force at the time of your order will apply to the contract between you and Zoliab
